Personal Injury FAQ

In the stressful and emotional time following an accident, it is important to know how to protect your legal rights and options. Here, we provide answers to frequently asked questions about being involved in an accident and bringing a personal injury claim in Minnesota.

Do I Need A Personal Injury Lawyer?

Hiring an attorney is not required.  However, having an attorney represent your interests gives you the best chance at recovering fair and just compensation for your injuries and resulting damages A lawyer is hired to be your advocate in all areas of the claim.

Insurance companies’ interests are different than the interests of their insured.   That is why having a lawyer is helpful.  Studies have shown that recoveries are up to 3 times greater with a lawyer representing an injured party than when an injured party represents themselves.

When Do I Need To Get An Attorney?

Most often, the sooner the better.  Evidence such as intersection cameras, 911 transcripts, body camera footage, photos of property damage and body damage, should be obtained right away to ensure preservation for use at a later date.

Additionally, insurance providers often start contacting the injured party the same day of the crash or shortly thereafter.  The representatives often ask questions that can be confusing to someone that was just involved in a crash, may have been injured, and may be on pain medication at the time of the conversation.

The insurance company will ask the injured party to sign papers that typically include authorizations that would allow the insurance company to request medical documents and other information about the insured, pertaining to the crash or otherwise.   Having a lawyer to review the documents and determine what is and is not necessary or required is helpful in limiting the disclosures to what is necessary.

What Does It Cost to Hire an Attorney?

Our personal injury attorneys work on a contingency fee basis, which means we only charge fees if we recover compensation for you.

Who Will Pay for My Medical Bills?

Minnesota is a No-Fault state which means that injured parties go first to their own insurance company to pay for initial medical bills.  Every auto insurance policy must offer a minimum of $20,000 in medical coverage and   $20,000 in wage loss or essential services. If have more than one vehicle insured with the same insurance company, you may have stacked benefits available to you, which means double or more of these benefits.

If you are not the insured in a policy, you will most likely have these benefits available to you if you live with someone that has coverage, or you were in an insured vehicle at the time of crash.   It is rare that Minnesota No-Fault benefits don’t apply to most situations.

For motorcyclists, no-fault insurance is elective, and you will need to purchase this elective coverage.

Most insurance companies will ask that you be examined by a doctor of their own choosing at some point during your treatment, sometimes as early as one month after the crash.  Insurance companies will fight paying benefits that insureds have paid for based on these examinations.  The injury attorney at Bowden Cyr knows what it takes to fight the insurance company in situations where the injured client needs more treatment that should be paid for by their insurance company.

Will My Insurance Rates Go Up?

Your insurance rates will not go up unless you are found more than 50 percent at fault for the accident.

Will I Need to File A Lawsuit?

Most likely, no.  Around 80% of all personal injury cases do not go to trial. The personal injury attorney should be fighting for the benefits owed and just compensation outside of involving the court system. The injury attorney at Bowden Cyr has over 25 years of experience at all stages and as a result, knows what and how to draft a persuasive demand for settlement that is effective and results in the insurance company offering just compensation.

When cases do not resolve, involving the court system is the next step.  The decision to go to trial or settle is up to the client.  The injury attorney at Bowden Cyr is your advocate and will provide recommendations and wise counsel for the next best steps given your case, your facts and your situation.

Who Do I Sue If I Need To?

If a fair settlement is not reached, a lawsuit is the next step. In Minnesota, the at fault driver and the owner of the at fault vehicle must be named as defendants.

How Long Does It Take to Reach A Settlement Or Verdict?

There is no simple answer to this question. After seeking medical treatment, investigating the scene, completing extensive paperwork, and communicating back-and-forth with the insurance company, it may be a year or more.  Timing is determined by injuries, treatment, and other factors regarding the evidence. You only have one shot at settling with the at fault driver’s insurance company, so it is critical to do it right the first time around.
